Has the statute of limitations run out?

Crooks and Liars has a clip of Joe Scarborough and C&L's emphasis is on Scarborough blaming the "liberal media" for branding waterboarding as torture. However, if you watch the entire clip, you will note that near the end he describes the allied attacks on Dresden at the end of World War II extremely accurately. He notes that there was no military objective and that the intent was to burn the city, kill women and children and terrorise the Germans. He then goes way out on a right wing limb and describes it as "probably immoral". So the question is, based on Mr. Scarborough's description was the fire bombing of Dresden (and other German cities):
  1. A war crime
  2. A crime against humanity
  3. An act of terrorism
  4. All of the above
