The US Court of Appeals in Richmond VA denied the appeal of Khaled el-Masri, a German citizen, in his case against the CIA for what he claims was his kidnapping and mistreatment or torture. The court found that government's right to keep secrets in order to preserve state security outweighs the right of a human being to be secure in his person and be treated within restrictions of domestic and international law. The appeals court decision said that Mr. el-Masri could not win his case exposing "how the C.I.A. organizes, staffs and supervises its most sensitive intelligence operations". Unless I am confused this would seem to allow the CIA to violate the law without judicial oversight. The decision is likely to be appealed.
