A Texas law, signed by no less lofty an eminence than the Decider(TM) himself, is at the heart of a court case that will decide the fate of Emilio Gonzales a terminally ill one and half year old boy believed to be suffering from Leigh's Disease, which has destroyed all of his higher brain functions. He cannot swallow or gag. He cannot, and will never, breathe on his own. Secretions have to be sucked from his lungs. The hospital contends that the treatment is aggressive, painful and serves no curative purpose. Under the Texas law a hospital has the right to decide to terminate care in futile cases and give the family ten days to have the patient transferred. A medical and ethics case has decided in Emilio's case to terminate care and notified his mother of the ten day period which has been extended at least once. No facility has been found willing to take Emilio and Federal judge has refused to intervene.
You can imagine how the sides line up. No one will win. Everyone will lose. I can readily understand the heartache of Ms. Gonzales and how difficult it must be for her and her family. Based on what the hospital's statements say as regards the boy's condition and prognosis I have to agree that they are almost certainly pursuing the correct course.
The hospital claims that finances are not an issue as Emilio is covered by Medicaid but I can imagine that there could have been no other reason for a self-described pro-lifer such as George to sign such a bill other than financial arguments from for profit hospitals.
