America & the rule of law (according to a Brit)

Lord Falconer, the Lord Chancellor, will today accuse the US government of a
shocking affront to the principles of democracy. The Lord Chancellor is effectively the most senior legal official in the government and is responsible for government policy on the legal system, heads the judiciary, is in charge of court system and presides over the House of Lords.

Oh yeah, and he gets to sit on the Woolsack.

He specifically charges that the US government is attempting to ensure that the executive branch is not subject to judicial oversight through the imprisonment of individuals at Guantanamo Bay.

He will say that "the rule of law must prevail just as much in times of terror as it does in times of peace. Every battle fought by a country that abides by the rule of law must be fought in accordance with rules and laws."

You will observe that he says every rather than some or most. Who within the US government is mounting this defense of the basic checks and balances?
