I smell a dishonourable discharge coming for someone

Two military judges presiding over "trial" at Guantánamo Bay Beach and Leisure Resort (GBBLR) have dealt a stunning blow to the Commander Guy's promises to bring all Evil Doers (EDs) to "justice" by throwing out all charges against the first two residents of the luxury facility to face a "trail" in the five years the resort has been open. A new law written especially to allow the EDs to be tried allowed for tribunals to be held for "unlawful enemy combatants" but none of the residents in Cuba are so designated, they are known only as "enemy combatants", and ergo it is unlikely that charges against any of them will stand.

One can assume that the US government will keep the residents in situ illegally as they have shown no qualms against doing so in the past. It is a good thing that the GBBLR is such a popular place and no one is eager to depart.

UPDATE: the prosecutors plan to appeal the decision to a court, the Court of Military Commissions Review, that doesn't exist.
